The penalty for visa violation varies according to the country of citizenship of the foreigner who committed the violation as of February 2023 and the duration of his/her stay in Turkey as a fugitive. In case of visa violation, you must pay the sum of the items listed above as a penalty. To repeat, the amount of fines and the items to be paid may vary depending on when you are being deported or when you will voluntarily leave the country.

The visa violation penalty can be paid to the visa violation offices located at the airports.
Is the Entry Ban to Turkey Applied in Case of Visa Violation?
In addition to the fine, depending on the duration of the visa violation, a ban on entry to Turkey may be applied.
Cases where the Entry Ban to Turkey Will Not be Applied
- Foreigners whose visa violation period is less than 3 months (not including 3 months) will not be banned from entering Turkey if they spontaneously come to the border gates to leave Turkey before this situation is detected by the competent authorities and pay the visa violation penalty.
- Foreigners whose visa violation period is less than 3 months (not including 3 months), if this situation is determined by the competent authorities and a deportation decision is made, foreigners who voluntarily come to the border gate and pay the visa violation fine during the period assigned to them will not be banned from entering Turkey. Cases where an Entry Ban Will be Applied to Turkey from 1 Month to 5 Years
Foreigners whose visa violation period is more than 3 months (including 3 months ), foreigners who pay the visa violation penalty by spontaneously coming to the border gates to leave Turkey before this situation is detected by the competent authorities;
- violation between 3 months and 6 months : entry ban for a period of 1 month
- violation between 6 months and 1 year : entry ban for 3 months
- violation between 1 year and 2 years : entry ban for a period of 1 year
- violation between Dec. 2 and 3 years : entry ban for a period of 2 years
- violation of more than 3 years : an entry ban of 5 years is applied.
Not Paying the Visa Violation Penalty or Circumstances in which the Ban on Entry to Turkey Will Be Applied Despite the Payment
Foreigners who have violated the legal right to stay and left the country or have been deported in the cases listed below are subject to an entry ban decision from 3 months to 5 years.
- Foreigners who do not pay the administrative fines arising from the Law on Fees No. 492, even though they spontaneously come to the border gates to leave Turkey before the violations of the legal right to stay are detected by the competent authorities.
- Foreigners who violate the legal right to stay for up to 3 months (not including 3 months) and who are invited to leave Turkey with a deportation decision, who do not exit within the time given to them or who do not pay the administrative fines arising from the Fees Law No. 492
Regardless of whether or not she has paid the administrative fines arising from the Fees Law No. 492;
- Foreigners who violate the legal right to stay for more than 3 months (including 3 months) regardless of whether they have paid the administrative fines arising from the Fees Law No. 492 and are invited to leave Turkey with a deportation decision.
- Foreigners who do not leave within the time granted to them, although their residence permit requests are rejected or their residence permits are cancelled, regardless of whether they have paid the administrative fines arising from the Fees Law No. 492
- Foreigners who do not exit within the time granted to them even though their work permit requests are rejected or their work permits are cancelled, regardless of whether they have paid the administrative fines arising from the Fees Law No. 492
- Foreigners who do not apply for a residence permit despite being allowed to enter our country, on the condition of applying for a residence permit within 10 days, despite using all the right to stay provided by the visa or visa exemption within the framework of the
- Foreigners who do not apply for a residence permit even though they have used all their right to stay within the framework of the “90 days in 180 days” rule and are allowed to enter our country, provided that they apply for a residence permit within 10 days. - Foreigners who are subject to alternative obligations by terminating the administrative detention decision regardless of whether they have paid the administrative fines arising from the Fees Law No. 492

The entry ban periods corresponding to the violation periods for foreigners within this scope are as follows:
- Violation up to 3 months : 3 months entry ban
- Violation between 3 months – 6 months violation: 6 months entry ban
- Violation between 6 months – 1 year violation: 1 year entry ban
- Violation between 1 year – 2 years violation: 2 years entry ban
- Violation for more than 2 years: Entry ban for 5 years applies.
Can Foreigners Who Didn’t Pay the Visa Violation Penalty and Deported Come to Turkey Again?
Foreigners who do not pay the administrative fines and other public receivables arising from the Fees Law and other legislation provisions are not allowed to enter our country unless they pay the said fines and public receivables.
Are Foreigners Violating Visa Deported?
Foreigners whose visa has expired, whose visa renewal application has been rejected, whose work permit has expired, and who, despite this, do not leave the country within the given period, may be deported and an entry ban to Turkey may be imposed.
